Evidence and Court Procedure

In mid-March the Supreme Court released and invited comment on a set of revised rules governing proceedings before the Court. Following the pattern it has set with decisions, these rules were released to the Internet (and are currently archived in both ascii and WordPerfect versions at ftp.cwru.edu. Subsequently, it released a final version of those rules which took effect Oct. 2, 1995. Working from the Court's WordPerfect file, the LII created a hypertext versions of the proposed rules and then the final rules. The LII's hypertext version includes links that allow readers to follow all cross references (from one rule to another) and links that connect to all sections of the U.S. Code and Constitution cited in the rules. [Click here to access the new Supreme Court Rules.]

On April 27, 1995, the Court issued proposed amendments to the Federal Rules of: Civil Procedure, Appellate Procedure, Bankruptcy Procedure, and Criminal Procedure. The LII has prepared and mounted on this site hypertext versions of both the Federal Rules of Evidence and the Federal Rules of Civil Procedure. While these rules are limited in their direct application to the Federal courts (at all levels), they have had a strong influence on state court procedure and evidence rules. They, therefore, generally serve as the framework for instruction on or analysis of procedure and evidence issues.
